1. Acceptance of Terms

By accessing or using MyoBot AI at myobotai.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including workspace owners, members, and visitors.

2. Description of Service

MyoBot AI is an agentic AI application platform that allows users to build, deploy, and manage AI agents for business use. Features include AI chat, knowledge base management, workflow automation, portal publishing, and multi-channel deployment. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts and Eligibility

You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of any party
• Transmit spam, malware, or other malicious content
• Generate or distribute harmful, deceptive, or illegal content using AI agents
• Attempt to gain unauthorized access to any system or data
• Resell or sublicense access to the Service without prior written consent
• Reverse engineer or attempt to extract the source code of the platform

We reserve the right to investigate and take appropriate action against violations, including account termination and reporting to law enforcement.

5. AI-Generated Content

The Service uses third-party AI models (such as those from Anthropic, OpenAI, and Google) to generate responses. AI-generated content may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and validating any AI output before acting on it or publishing it to end users.

We do not guarantee the accuracy, reliability, or fitness of AI-generated content for any particular purpose.

6. Subscription Plans and Billing

The Service is offered on a subscription basis with tiered plans. Billing is handled by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis for the selected plan.

Plan limits (tokens, agents, storage, members, channels) apply as described on the pricing page. Exceeding limits may result in throttling or access restrictions until the next billing period or an upgrade.

Refunds are not provided for partial billing periods. You may cancel your subscription at any time; access continues until the end of the current paid period.

7. Your Content

You retain ownership of all content you upload or create within the Service, including documents, agent configurations, workflow data, and conversation histories ("Your Content").

By using the Service, you grant us a limited, non-exclusive licence to store, process, and transmit Your Content solely to operate and provide the Service. We do not use Your Content to train AI models or share it with third parties except as described in our Privacy Policy.

8. Intellectual Property

All rights in the Service, including the platform interface, underlying code, branding, and documentation, are owned by MyoBot AI or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or trade names.

9. Third-Party Services

The Service integrates with third-party services including Stripe, Google, Facebook, and AI model providers. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, MyoBot AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless MyoBot AI and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for breach of these Terms, non-payment, or other legitimate reason, with notice where practicable. Upon termination, your access to the Service ceases and we may delete Your Content after a reasonable retention period, except where required by law.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice on the Service at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of the applicable jurisdiction.
